These General Terms and Conditions govern the legal relationship between Speed-Net GmbH and the customer who uses the services of Speed-Net GmbH.
Contract Conclusion
The contract for the use of Speed-Net GmbH services is concluded by submitting the online form and takes effect immediately. Offers and Prices
Payment Terms
New accounts are set up against an invoice payable within 10 days. In the event of non-payment of the amount owed, Speed-Net GmbH reserves the right to take legal action. Speed-Net GmbH sends a payment reminder to the customer after the payment deadline expires and before deactivating the account. Deactivation occurs if no payment has been received 7 days after the payment reminder. Speed-Net GmbH is generally authorized to delete accounts, including their content, after the payment deadline expires. If the customer is more than 14 days late with a payment, reminder fees of CHF 25.– must be paid from the second payment reminder onwards. For existing accounts, a payment deadline of 10 days applies. They are typically charged one month before the contract expires. In case of payment delay, a reminder is sent by email. If payment has not been received by the end of the paid contract term, the account may be suspended immediately. For reactivation, Speed-Net GmbH may charge a fee of at least CHF 50.–.
Subscription Deletion
Services of Speed-Net GmbH
Speed-Net GmbH guarantees that all services included in the offer (according to the offer descriptions on Speed-Net GmbH's websites) can be used throughout the entire paid contract term. Speed-Net GmbH may change the scope of services at any time if certain offers and options affect server stability or if standard improvements are to be made.
Customer Obligations
Data Backup
The customer is responsible for backing up the data stored on their account. In the event of data loss, the customer is obligated to use their own backup copies. Although Speed-Net GmbH creates regular backups, their use can neither be demanded nor guaranteed. If Speed-Net GmbH performs a restoration of lost data, a reasonable compensation for effort may be charged. Speed-Net GmbH cannot be held liable for the deletion of data.
Domain Registration
Speed-Net GmbH will, upon request after contract conclusion, apply for the desired domain name with SWITCH or the respective registrar for COM/NET/ORG/BIZ and INFO domains. However, Speed-Net GmbH cannot guarantee that the desired domain name will actually be assigned to the customer by the registration authority. If a requested domain name is already taken, the customer may choose a different domain name. After successful domain registration, a change of domain name is no longer possible. The customer has no right to the "money-back" guarantee for domain names ordered with Speed-Net GmbH. Speed-Net GmbH cannot be held liable for domain loss due to technical or other reasons. Speed-Net GmbH assumes no liability for domain loss due to insufficient, incorrect, or missing invoicing and resulting non-payment. For all domain names registered by Speed-Net GmbH, the customer is registered as the owner and can switch to another provider at any time.
Responsibility and Liability
Speed-Net GmbH assumes no responsibility whatsoever for the data and actions that the customer stores, publishes, or performs by using their account. Liability rests exclusively with the customer. If the customer transfers their account or parts of it to third parties – whether for payment or free of charge – they are automatically also liable for them. Speed-Net GmbH strives to inform customers in advance about planned maintenance work or other service interruptions. However, Speed-Net GmbH cannot be held liable for service interruptions, particularly due to maintenance work, troubleshooting, or force majeure. Speed-Net GmbH disclaims all liability for associated damages, penalties, fines, claims for compensation, lost profits or orders, and other claims.
Data Protection
Customer data is collected, processed, and used in strict confidence in accordance with the provisions of the General Data Protection Regulation (GDPR) and Swiss data protection and telecommunications law. Customer data is used only within Speed-Net GmbH and is not disclosed to third parties. The customer is obligated to provide their data (company name and legal form, name, address, telephone, email, etc.) truthfully when placing the order and to notify Speed-Net GmbH immediately and unprompted of any changes to this data. Mandatory disclosure of data by Speed-Net GmbH only occurs in connection with corresponding orders (e.g., domain registration, certificate issuance, etc.) or upon request by authorities. For more information, see our privacy policy.
Contact Addresses
In the event of address changes (email or postal), the customer is obligated to notify Speed-Net GmbH to avoid difficulties in making contact.
